Termini di servizio di Playerz

I presenti Termini di servizio (i Termini) regolano l'accesso e l'utilizzo dell'app Playerz, del sito playplayerz.app e dei servizi collegati (insieme, il Servizio). Utilizzando il Servizio l'utente accetta i presenti Termini. Se non li accetta, non deve utilizzare il Servizio.

Il trattamento dei dati personali è descritto nella Privacy Policy, che costituisce parte integrante del rapporto con l'utente.

Playerz è attualmente in fase beta. Le funzionalità possono cambiare, essere sospese o rimosse durante lo sviluppo e il Servizio è fornito nei limiti indicati nella sezione 12.

2. Requisiti per l'utilizzo

Durante l'attuale beta, Playerz è destinata esclusivamente a persone che hanno compiuto 18 anni. Chi non ha compiuto 18 anni non deve creare un account né utilizzare il Servizio.

Per utilizzare il Servizio l'utente deve fornire informazioni veritiere e disporre della capacità giuridica per accettare i presenti Termini.

3. Account e sicurezza

Per accedere alle funzioni principali è necessario creare un account, tramite email e password oppure con Google Sign-In. L'utente si impegna a:

fornire dati esatti e mantenerli aggiornati;
custodire le proprie credenziali e non condividerle con terzi;
essere responsabile delle attività svolte tramite il proprio account;
comunicare tempestivamente qualsiasi utilizzo non autorizzato dell'account.

Playerz può rifiutare, sospendere o disattivare un account in caso di violazione dei Termini, rischi per la sicurezza o abusi.

4. Il Servizio

Playerz è una piattaforma sociale a tema sportivo che consente, tra l'altro, di creare un profilo, gestire squadre, community, eventi e tornei, partecipare a partite, comunicare con altri utenti, caricare contenuti e ricevere statistiche, voti, riconoscimenti e classifiche a finalità ludico-sportive.

Il Servizio comprende anche pagine web pubbliche su playplayerz.app e una funzione di ricerca che consente a chiunque, anche senza account, di trovare partite di campionato, tornei, squadre ed eventi aperti. Il perimetro di ciò che è pubblicamente cercabile, e ciò che ne resta escluso, è descritto nella Privacy Policy.

Le funzioni disponibili possono variare in base al ruolo, alle impostazioni, alla piattaforma e alla fase di sviluppo del Servizio.

5. Contenuti degli utenti

L'utente può caricare, pubblicare e condividere contenuti, ad esempio testi, foto, video, loghi, risultati, voti e commenti (i Contenuti dell'utente). L'utente resta titolare dei diritti sui propri Contenuti.

Caricando o pubblicando Contenuti, l'utente concede a Playerz una licenza non esclusiva, gratuita e limitata a ospitare, archiviare, riprodurre, adattare tecnicamente e mostrare tali Contenuti nella misura necessaria a fornire e far funzionare il Servizio, incluse le funzioni sociali, di condivisione e le pagine pubbliche del sito, comprese quelle raggiungibili tramite la ricerca pubblica. La licenza cessa quando i Contenuti vengono rimossi, salvo per le copie tecniche o di backup temporanee e per quanto necessario ad obblighi di legge o alla tutela dei diritti.

L'utente dichiara e garantisce che:

dispone dei diritti necessari a caricare e condividere i Contenuti;
i Contenuti non violano diritti di terzi né la legge applicabile;
rispetta i diritti delle persone ritratte, con particolare attenzione ai minori.

6. Regole di condotta

Utilizzando il Servizio, l'utente si impegna a non:

pubblicare contenuti illeciti, diffamatori, osceni, violenti, discriminatori, d'odio o che incitino a comportamenti illeciti;
molestare, minacciare, intimidire o violare la privacy di altre persone;
pubblicare materiale sessuale che coinvolga minori o contenuti che sfruttino o mettano in pericolo minori;
caricare contenuti di cui non detiene i diritti o che violino proprietà intellettuale altrui;
inviare spam, contenuti ingannevoli, truffe o pubblicità non autorizzata;
impersonare altre persone o dichiarare falsamente un'affiliazione;
diffondere malware o tentare di compromettere la sicurezza, l'integrità o la disponibilità del Servizio;
accedere al Servizio con mezzi automatizzati non autorizzati, estrarre dati in massa o aggirare limiti tecnici e misure di sicurezza;
utilizzare il Servizio in modo da danneggiare Playerz o altri utenti o in violazione dei presenti Termini o della legge.

Playerz applica una politica di tolleranza zero verso contenuti e comportamenti gravemente abusivi.

7. Moderazione, segnalazioni e blocchi

Il Servizio mette a disposizione strumenti per segnalare contenuti o utenti e per bloccare altri utenti. Playerz può utilizzare controlli automatici e umani per individuare violazioni, come descritto nella Privacy Policy.

In caso di violazione dei Termini, Playerz può, nella misura proporzionata, rimuovere o limitare contenuti, ridurne la visibilità, sospendere funzioni o account, fino alla disattivazione definitiva. Ove ragionevole, l'utente ne sarà informato; misure immediate possono essere adottate in caso di rischi gravi o obblighi di legge.

8. Statistiche, voti e classifiche

Statistiche, medie, voti, pagelle, ranking, riconoscimenti e risultati generati dal Servizio hanno finalità informative e ludico-sportive. Possono basarsi su elaborazioni automatiche e su dati inseriti dagli utenti, possono contenere imprecisioni e non producono effetti giuridici né costituiscono un giudizio ufficiale o professionale.

9. Proprietà intellettuale di Playerz

Il Servizio, il marchio Playerz, il software, l'interfaccia, la grafica e gli altri elementi forniti da Playerz sono protetti dai diritti di proprietà intellettuale del titolare o dei suoi licenzianti. Non è concesso alcun diritto oltre a quello di utilizzare il Servizio secondo i presenti Termini. È vietato copiare, modificare, distribuire, decompilare o creare opere derivate dal Servizio, salvo quanto consentito dalla legge.

10. Servizi e contenuti di terzi

Il Servizio si avvale di fornitori terzi (ad esempio Google/Firebase, Google Maps, Google Gemini e OpenAI) e può contenere link o contenuti di terzi. L'uso di tali servizi può essere soggetto ai relativi termini e informative. Playerz non è responsabile dei contenuti, dei prodotti o dei servizi di terzi.

11. Cancellazione dell'account e cessazione

L'utente può cessare l'utilizzo del Servizio in qualsiasi momento e cancellare il proprio account dalla sezione Altro > Elimina account dell'app oppure seguendo le istruzioni disponibili alla pagina https://playplayerz.app/account-deletion. Gli effetti della cancellazione sono descritti nella Privacy Policy.

Playerz può sospendere o cessare il Servizio, in tutto o in parte, o l'accesso di un utente, in caso di violazione dei Termini, esigenze tecniche, di sicurezza o legali. Le disposizioni che per loro natura devono sopravvivere alla cessazione restano efficaci.

12. Disponibilità del Servizio e beta

Il Servizio è fornito "così com'è" e "come disponibile". Trattandosi di una beta, possono verificarsi interruzioni, errori, perdita di dati o modifiche delle funzioni. Nei limiti consentiti dalla legge, Playerz non garantisce che il Servizio sia privo di errori, ininterrotto, sicuro o adatto a finalità specifiche dell'utente.

Le presenti limitazioni non escludono né riducono le garanzie e i diritti inderogabili riconosciuti ai consumatori dalla legge applicabile.

13. Limitazione di responsabilità

Nei limiti massimi consentiti dalla legge, Playerz non è responsabile per danni indiretti, incidentali o consequenziali, per la perdita di dati o di opportunità, né per condotte o contenuti di altri utenti o di terzi. Nulla nei presenti Termini esclude la responsabilità che non può essere limitata per legge, incluso il dolo o la colpa grave e la responsabilità verso i consumatori prevista da norme inderogabili.

14. Modifiche ai Termini

Playerz può aggiornare i presenti Termini per riflettere modifiche del Servizio, dei fornitori o della normativa. La versione aggiornata sarà pubblicata con la nuova data di aggiornamento. Quando una modifica incide in modo sostanziale, Playerz ne darà comunicazione nell'app o tramite un altro canale appropriato. L'uso del Servizio dopo l'entrata in vigore delle modifiche costituisce accettazione delle stesse.

15. Legge applicabile e foro competente

I presenti Termini sono regolati dalla legge italiana. Per l'utente che agisce come consumatore resta competente il foro del luogo di residenza o domicilio, se situato in Italia, e restano applicabili le norme inderogabili a tutela del consumatore. Per gli altri utenti è competente in via esclusiva il foro di Como.

Playerz Terms of Service

These Terms of Service (the Terms) govern access to and use of the Playerz app, the playplayerz.app website and related services (together, the Service). By using the Service you accept these Terms. If you do not accept them, you must not use the Service.

The processing of personal data is described in the Privacy Policy, which forms an integral part of the relationship with the user.

Playerz is currently in beta. Features may change, be suspended or removed during development, and the Service is provided within the limits set out in section 12.

2. Eligibility

During the current beta, Playerz is intended exclusively for people aged 18 or over. Anyone under 18 must not create an account or use the Service.

To use the Service you must provide truthful information and have the legal capacity to accept these Terms.

3. Account and security

Accessing the main features requires creating an account, either with an email address and password or with Google Sign-In. You undertake to:

provide accurate information and keep it up to date;
safeguard your credentials and not share them with third parties;
be responsible for the activity carried out through your account;
promptly report any unauthorised use of your account.

Playerz may refuse, suspend or deactivate an account in the event of a breach of the Terms, security risks or abuse.

4. The Service

Playerz is a sports-themed social platform that allows you, among other things, to create a profile, manage teams, communities, events and tournaments, take part in matches, communicate with other users, upload content and receive statistics, ratings, awards and rankings for recreational and sporting purposes.

The Service also includes public web pages on playplayerz.app and a search feature that allows anyone, including people without an account, to find league matches, tournaments, teams and open events. The scope of what is publicly searchable, and what is excluded from it, is described in the Privacy Policy.

Available features may vary depending on role, settings, platform and the stage of development of the Service.

5. User content

You may upload, publish and share content, for example text, photos, videos, logos, results, ratings and comments (User Content). You retain ownership of the rights in your Content.

By uploading or publishing Content, you grant Playerz a non-exclusive, royalty-free and limited licence to host, store, reproduce, technically adapt and display that Content to the extent necessary to provide and operate the Service, including the social and sharing features you choose to use and the public pages of the website, including those reachable through public search. The licence ends when the Content is removed, except for temporary technical or backup copies and as necessary to comply with legal obligations or protect legal rights.

You represent and warrant that:

you hold the rights necessary to upload and share the Content;
the Content does not infringe third-party rights or applicable law;
you respect the rights of the people depicted, with particular attention to minors.

6. Rules of conduct

When using the Service, you undertake not to:

post unlawful, defamatory, obscene, violent, discriminatory or hateful content, or content that incites unlawful behaviour;
harass, threaten, intimidate or invade the privacy of other people;
post sexual material involving minors or content that exploits or endangers minors;
upload content you do not hold the rights to or that infringes someone else's intellectual property;
send spam, deceptive content, scams or unauthorised advertising;
impersonate other people or falsely claim an affiliation;
distribute malware or attempt to compromise the security, integrity or availability of the Service;
access the Service by unauthorised automated means, extract data in bulk or circumvent technical limits and security measures;
use the Service in a way that harms Playerz or other users, or in breach of these Terms or the law.

Playerz applies a zero-tolerance policy towards seriously abusive content and behaviour.

7. Moderation, reports and blocks

The Service provides tools to report content or users and to block other users. Playerz may use automated and human checks to detect breaches, as described in the Privacy Policy.

In the event of a breach of the Terms, Playerz may, to a proportionate extent, remove or restrict content, reduce its visibility, suspend features or accounts, up to permanent deactivation. Where reasonable, you will be informed; immediate measures may be taken in the event of serious risks or legal obligations.

8. Statistics, ratings and rankings

Statistics, averages, ratings, player ratings, rankings, awards and results generated by the Service are for informational, recreational and sporting purposes. They may be based on automated processing and on data entered by users, may contain inaccuracies, and produce no legal effects nor constitute an official or professional assessment.

9. Playerz intellectual property

The Service, the Playerz trade mark, the software, the interface, the graphics and the other elements provided by Playerz are protected by the intellectual property rights of the owner or its licensors. No right is granted beyond that of using the Service in accordance with these Terms. Copying, modifying, distributing, decompiling or creating derivative works from the Service is prohibited, except as permitted by law.

10. Third-party services and content

The Service relies on third-party providers (for example Google/Firebase, Google Maps, Google Gemini and OpenAI) and may contain third-party links or content. Use of those services may be subject to their own terms and notices. Playerz is not responsible for third-party content, products or services.

11. Account deletion and termination

You may stop using the Service at any time and delete your account from the More > Delete account section of the app, or by following the instructions available at https://playplayerz.app/account-deletion. The effects of deletion are described in the Privacy Policy.

Playerz may suspend or discontinue the Service, in whole or in part, or a user's access to it, in the event of a breach of the Terms or for technical, security or legal reasons. Provisions that by their nature must survive termination remain in force.

12. Availability of the Service and beta

The Service is provided "as is" and "as available". As it is a beta, interruptions, errors, data loss or changes to features may occur. To the extent permitted by law, Playerz does not warrant that the Service will be error-free, uninterrupted, secure or fit for your particular purposes.

These limitations do not exclude or reduce the warranties and mandatory rights granted to consumers by applicable law.

13. Limitation of liability

To the maximum extent permitted by law, Playerz is not liable for indirect, incidental or consequential damages, for loss of data or opportunity, nor for the conduct or content of other users or third parties. Nothing in these Terms excludes liability that cannot be limited by law, including wilful misconduct or gross negligence and liability towards consumers under mandatory rules.

14. Changes to the Terms

Playerz may update these Terms to reflect changes to the Service, to its providers or to the law. The updated version will be published with the new update date. Where a change has a material impact, Playerz will give notice in the app or through another appropriate channel. Use of the Service after the changes take effect constitutes acceptance of them.

15. Governing law and jurisdiction

These Terms are governed by Italian law. For users acting as consumers, the courts of their place of residence or domicile remain competent if located in Italy, and mandatory consumer protection rules continue to apply. For all other users, the courts of Como have exclusive jurisdiction.
